NICOCASA presents this concise guide to enlighten our prospective clients as to how our business works, from the research of the right property to the conclusion of a deed of sale in a clear way that is efficient following these simple points….


THE RESEARCH

1) We suggest as a good rule that our prospective clients book an:
- appointment at one of our offices so that we may focus together on the main
- property characteristics that you are looking for.
- Preferred area
- The size
- The type (apartment, cottage, villa etc)
- The structure (new, liveable, in need of restructure etc)
- External space
- Any particular requirements (garage, land, single storey etc)

2) For each property that meets your requirements the agency will present a clear description together with any relative details, plans and photos.
At the end of the viewing you can select a series of properties that you will be able to visit together with us on future appointments.

3) At the same time you can be added to our mailing list and contacted with any future properties that we may feel be of interest to you.


THE ACQUISITION

1) Once you have chosen your selected property and fixed the price with the seller you will need to entrust the liaison of your chosen technical consultant. In the event of not having one we can nominate one for you from our extensive list of qualified professionals (engineers, geometras or architects) who will ensure a structural check with the relative documentation. We will take care to deliver any such documents to you in the fastest time possible. In order to avoid any nasty surprises we would also suggest that you ask your consultant for a full and detailed breakdown of all costs that you are likely to incur during the purchase of this property.
- Consultants report, checks and technical assistance.
- Costs of the Notaio and duties
- Estate Agency
- Transfer or connection to utilities

2) You will be asked for a copy of valid identification, your fiscal code and a signature of consent regarding the treatment of personal data (Privacy Law D.Lgs 196/2003).

3) At the same time with the assignments appointed to the consultant, you will have in your power, underwritten by the agency a proposal of acquisition. The proposal of acquisition is a pre-printed form and its use is appointed solely to estate agents and is registered by the Chamber of Commerce. The Proposal of Acquisition, once accepted by the seller permits the buyer to:
- Reserve the house ‘under offer’ for a period of 20/30 days. (This is the vital period when the buyer can carry out any necessary checks).
- Make a clear statement to the seller of his/her firm intention to buy
- Fix a written price
- Establish a time scale for the conclusion of business

Achieve a good result from the negotiation of the checks that determine the conditions of the property, in particular of the property being in a saleable state and in regulation with the urban and land registry laws or for the attainment of a mortgage.

A serious proof of intention, the proposal of acquisition obligates the buyer to pays across a small sum as a deposit to the agency that will be refunded to the buyer in the event of the sale not concluding.

4) At the end of all necessary checks on the property, with the outcome of these being satisfactory to the buyer, you will be guided to the conclusion of business with your technical consultant in collaboration with the agency and the technical consultant assigned to the seller with the drafting of the ‘preliminare di compravendita’ or the ‘compromesso’ With the signature of the compromesso the agency reserves the right to commission.
With the new law, from 01.01.2007, by the l’Agenzia delle Entrate the estate agent must register the compromesso at their office and therefore you will be requested by the private drafting of this document to make the necessary tax registration (if needed) and the necessary tax stamps.
The compromesso obligates the buyer to make the payment of a confirmed deposit (the maximum being 30% of the price).


THE FINAL DEED OF SALE

Before the termination of the established time scale, the estate agent together with the entrusted technical consultant will negotiate at the pre-chosen Notaio’s office. They will prepare the completion of the final deed of sale and deliver all necessary documentation to the Notaio who will draft the document. On the agreed day of the final deed of sale it is important to provide the Notaio with a valid document of identification and your fiscal code. From 2006, buyers and sellers are legally bound at this meeting to declare an assigned mediator together with the details of the relative payment of commission, they will be inserted into the notarial contract (in the case of false declaration there are penal sanctions).


THE ACQUISITION OF A MORTGAGE

In the case of necessitating a mortgage, we can help you to find the suitable finance for your requirements, consulting and requesting proposals and details from many credit institutions. NICOCASA estate agent has ‘agreements’ drawn up with important bank and financial groups who can ensure a client receives a mortgage guaranteeing the best possible conditions. You will be requested to provide copies of personal documents and of your most recent pay slips and or your last declaration of income.


NICOCASA’S COMMISSION CHARGES

At the conclusion of business the agency of NICOCASA will apply, as is the general rule in this area, a commission charge that comprises of:
- Visits to selected properties
- The negotiation between a buyer and a seller
- The drafting of a possible proposal of sale and or a compromesso
- The assistance in a contract with the agreement of the assigned consultant
- The request for transfer of utilities to be undertaken at the appropriate offices

A lawyer entrusted by us can be present in our offices at your request. For a separate charge he can be available to offer consultation, assistance and any necessary suggestions for a good acquisition.
